13. DURATION This marriage contract begins from the date of its implementation and enters into force for an indeterminate period, unless it is repealed by the explicit written agreement of both parties in accordance with paragraph 14 above. A prenup may protect assets already acquired by one partner from not being claimed by the other, but these assets should normally be detailed in the agreement. Unlike all other contract laws, no consideration is necessary, although a minority of courts denounce marriage itself in return. Through a prenup, a spouse can completely waive property rights, support or inheritance, as well as the voting share, and can get nothing for it. The choice of legal provisions is crucial in the prenups. Contracting parties may decide that the law of the state in which they are married governs both the interpretation of the agreement and the division of property at the time of divorce. In the absence of a legal choice clause, it is the law of the place where the parties divorce, not the law of the state in which they were married, that decides matters of ownership and support. 10. Children children of marriage (whether biological or adopted) have no bearing on the terms of this marriage contract and nothing in this marriage contract affects the children`s right to assistance. In most Arab and Islamic countries, there is a marriage contract traditionally known as aqd qeran, aqd nikkah or aqd zawaj, which has long been established as an integral part of an Islamic marriage and is signed at the wedding.
In Egypt, Syria, Palestine, Jordan and Lebanon, this treaty is widely known as Katb el-Kitab. The treaty is similar to Ketubah in Judaism and describes the rights and duties of the groom and bride or other parties involved in the marital proceedings. However, this is something other than a marital agreement, as it does not specify how assets should be split or inherited in the event of a divorce or the death of a spouse.
